1. Who we are and acceptance
These Terms & Conditions (“Terms”) govern your access to and use of the website www.paps.ai, the PAPS AI platform and applications, and the PAPS Studio services (together, the “Services”), operated by Opperator AI FZCO, trading as PAPS AI (“PAPS AI”, “we”, “us”), IFZA Business Park, Dubai Silicon Oasis, Dubai, United Arab Emirates. By using the Services, creating an account or purchasing a subscription, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a company, you confirm you are authorized to bind it.
2. The Services
PAPS AI provides software-as-a-service: AI agents that answer and engage across phone, WhatsApp, website chat, email, LinkedIn and social networks, with an included AI CRM. PAPS Studio provides done-for-you services: Social Media Management + Clipping (content creation and clipping, native publishing, answering of comments and direct messages, and performance reporting) and new website design, development and implementation. Current plans, allowances and prices are published at www.paps.ai/pricing and in your order. We may improve or modify features provided the core service you purchased is not materially reduced.
3. Accounts
You must provide accurate information, keep your credentials confidential and be at least 18 years old. You are responsible for activity under your account. Notify us immediately of unauthorized use.
4. Social platform authorizations
Parts of the Services connect to third-party platforms — Meta (Facebook, Instagram, WhatsApp Business), TikTok, YouTube (Google), X and LinkedIn — exclusively through their official APIs and only after you authorize access through each platform’s consent flow. By connecting an account you (a) confirm you own or are authorized to manage it; (b) instruct and authorize us to publish content, read and answer comments and direct messages, and retrieve performance data on that account on your behalf; and (c) agree to comply — and to ensure the content you approve complies — with the applicable platform terms, including the Meta Terms of Service and Platform Terms, the TikTok Terms of Service, the YouTube Terms of Service, the X Terms of Service and the LinkedIn User Agreement. You can revoke any authorization at any time in the platform’s settings; the related features then stop working. We are independent from these platforms: they do not sponsor or endorse PAPS AI, and we are not responsible for their availability, policies or decisions affecting your accounts.
5. AI disclosure and human oversight
The Services use artificial intelligence to create content and to hold conversations. AI-run conversations are disclosed as AI. AI output can contain errors; you are responsible for reviewing the knowledge you provide, the content you approve for publishing, and any decision you take based on AI output. The Services are not a substitute for professional legal, medical or financial advice.
6. Acceptable use
You agree not to use the Services to send spam or unlawful communications; to violate any platform’s terms or rate limits; to publish content that is illegal, infringing, deceptive, hateful or harmful; to contact people without a lawful basis; to attempt to breach, overload or reverse-engineer the Services; or to misrepresent AI conversations as human. We may suspend or terminate accounts that put the Services, other customers or our platform partnerships at risk.
7. Your content and data
You retain all rights to the content, knowledge and data you provide and to the content we create for you under a PAPS Studio engagement once paid for. You grant us a limited licence to host, process, adapt and publish that content solely to provide the Services. Data protection is governed by our Privacy Policy, including how to request deletion.
8. Fees, billing and refunds
Subscriptions are billed in advance (monthly or annually) at the prices shown at the time of order; one-time services such as website design are billed as quoted. Usage allowances and overage rates are listed on the pricing page. Prices exclude applicable taxes. Payments are processed by third-party payment providers. Subscriptions renew automatically until cancelled; you can cancel at any time effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable; if we permanently discontinue a paid service, we refund the unused portion pro rata.
9. Intellectual property
The Services, including software, design, trademarks and documentation, are and remain the property of Opperator AI FZCO or its licensors. No rights are granted except the limited right to use the Services under these Terms. Third-party names and logos belong to their respective owners.
10. Warranties and disclaimers
We provide the Services with professional skill and care, and we work to keep them available 24/7, but the Services are provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation, specific business results, views, reach, rankings, lead volumes or revenue. Performance figures on our website are representative deployment scenarios, not guarantees.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or related to the Services is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You will indemnify and hold PAPS AI harmless from third-party claims arising out of content you provide or approve, your breach of these Terms, or your violation of law or of platform terms, except to the extent caused by our breach.
13. Termination
You may stop using the Services and cancel at any time. We may suspend or terminate the Services for material breach that remains uncured 14 days after notice, or immediately for unlawful use or risk to the platform. Upon termination your access ends and data is handled per the Privacy Policy; clauses that by nature survive (IP, liability, governing law) survive.
14. Changes to these Terms
We may update these Terms; the date above reflects the latest version. Material changes will be announced on this page or by email, and continued use after the effective date constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. The courts of Dubai, United Arab Emirates have exclusive jurisdiction, without prejudice to mandatory consumer protections of your country of residence.
